Terms of use
Last updated:
These terms are the rules for using Yutemi, the Android and iPhone app offered by Emanuel Álvarez Sánchez (Bogotá, Colombia). By creating your account you accept them, together with the Privacy policy. If you don't agree, don't use the app.
What Yutemi is
Yutemi is a tool to organize your time: schedule, tasks, projects, habits, weekly review, focus mode and a personal journal. It is an aid for your organization; it is not medical, psychological, legal or any other kind of professional advice, and the decisions you make with it are yours.
User sign-up
To use Yutemi you need to create an account in the app with your email and a password. Signing up is free; the Pro subscription is optional. When you tap "Create account":
- You accept these terms and the Privacy policy. You confirm that you have read them and agree with them. Both documents are always available on this site, with the date of their latest version.
- You authorize the processing of your data for the purposes described in the Privacy policy. If you write in the journal, which may contain sensitive data about your health or private life, you expressly consent to us storing and syncing it only to show it to you. You can withdraw your consent at any time (see Your data).
- You declare that you meet the minimum age: 13 years old, or the age your country's law requires to consent to digital services if it is higher (in the European Union it ranges from 13 to 16 depending on the country). If you are between 13 and 17, you also need authorization from your mother, father or legal guardian.
- You commit to giving truthful information, using an email address of your own and not impersonating anyone.
- You agree to receive the service emails your account needs, such as password recovery. We do not send promotional emails.
If you do not accept these terms or the Privacy policy, do not create an account. If they change significantly, we will explain it before the change applies (see Changes to these terms).
Your account
- Use an email address that is yours and that you can access: you need it to recover your password.
- Take care of your password. What is done with your account is your responsibility, unless you tell us about unauthorized use.
- Each account is personal: don't share or sell it.
Acceptable use
Don't use Yutemi to:
- break the law or other people's rights;
- try to access other people's accounts or data, or parts of the service not meant for you;
- overload, interfere with or damage the service, or automate its use abusively;
- copy, decompile or resell the app, except as the law allows;
- get around the Free plan limits or the subscription controls.
Your content
What you write and create in Yutemi is yours. You give us permission only to store it, sync it between your devices and show it to you, which is what's needed to provide the service. We don't use it for anything else, we don't sell it and we don't use it for advertising. You can export or delete it whenever you want (see Your data). The app, its brand and its design are ours: how you may use them is in Intellectual property.
Free and Pro plans
- Free: includes the app with some limits: currently up to 15 active tasks, 2 projects, 3 habits and 1 active device at a time. Your whole history is always fully visible. The app shows the current limits for your account. If a limit changes, it never becomes stricter for your account: stricter changes only apply to new accounts.
- Pro: removes those limits. It is offered as a monthly or yearly subscription with automatic renewal. The price, currency and billing period are the ones the store shows in your country before you buy.
- Free trial: the yearly plan may include a 7-day trial for people who haven't used it before. The store asks for a payment method and, if you don't cancel before it ends, charges the first year. We remind you before the charge.
- Renewal and cancellation: the subscription renews automatically at the end of each period unless you cancel it at least 24 hours before in the store (App Store or Google Play). When you cancel, you keep Pro until the end of the paid period. Deleting your account does not cancel the subscription.
- Refunds: charges and refunds are handled by the store under its own rules; request them from Apple or Google. How to do it, and when we help you ourselves, is in the Refund policy.
- Back to Free: If Pro ends, your account moves to Free without deleting anything. Everything you created stays visible and editable; while you're over a Free plan limit, you just can't create new items of that type.
- Price changes: if the Pro price changes, the store notifies you and asks for your confirmation when required, under its rules. You can cancel before it applies.
- For everything related to payments, if these terms and the conditions of the store where you bought don't match, the store's conditions prevail.
Availability and offline use
The app works offline and syncs your changes when it's back online. We do our best to keep the service always available and your data safe, but there may be interruptions due to maintenance, failures or causes beyond our control. We recommend exporting your data from time to time if it matters to you. We may change, improve or remove features; if we remove something you paid for with Pro, we will explain it in advance.
Closing your account
- You can delete your account whenever you want from the app (Profile and settings → Account → “Delete my account”).
- We may suspend or close an account that seriously breaches these terms or the law. Unless the law or the seriousness of the case prevents it, we will warn you by email first and give you the chance to export your data.
Liability
We offer Yutemi as is and to the extent the law allows. We are not liable for indirect damages, for decisions made based on the app, or for failures of third-party services (stores, internet or phone providers). None of this limits the rights consumer protection law gives you, or our liability where the law doesn't allow it to be limited.
Changes to these terms
If we change these terms, we will update the “Last updated” date and note it in the change log. If the change is significant, we will explain it clearly before it applies. If you keep using the app afterwards, you accept the new terms; if you don't agree, you can delete your account.
Governing law
These terms are governed by the laws of the Republic of Colombia, without prejudice to the rights granted to you by the consumer protection law of your country of residence.
